THE SWEEPSTAKES AND ANY ADVERTISEMENT RELATING THERETO ARE INTENDED FOR PARTICIPATION AND VIEWING ONLY WITHIN THE STATES OF ARIZONA, MINNESOTA, WISCONSIN, CALIFORNIA, WASHINGTON, MICHIGAN, PENNSYLVANIA, GEORGIA, COLORADO, OHIO, FLORIDA, MISSOURI, TEXAS, AND ILLINOIS AND SHALL BE CONSTRUED ACCORDING TO, AND GOVERNED EXCLUSIVELY BY, UNITED STATES LAW. VOID WHERE PROHIBITED.
1. PROMOTION DESCRIPTION: The eHarmony Dream Date Sweepstakes Promotion (the “Promotion”) consists of a nineteen (19) separate sweepstakes random drawings (each a “Sweepstakes”) and offers entrants the chance to win admission for two (2) to a big league baseball game in their region, as more fully set forth below. Entry in one Sweepstakes does not constitute entry into any other promotion, contest or Sweepstakes. By participating in a Sweepstakes, each entrant unconditionally agrees to abide by these Official Rules and the decisions of National Sports Programming (“Sponsor”) and Van Wagner Communications, Inc. (“Administrator”), which shall be final and binding in all matters relating to this Promotion.
2. ELIGIBILITY: The Promotion is open only to legal residents of the States of Arizona, Minnesota, Wisconsin, California, Washington, Michigan, Pennsylvania, Georgia, Colorado, Ohio, Florida, Missouri, Texas, and Illinois, USA who are eighteen (18) years of age or older at the time of entry. Void where prohibited. Employees, officers, and directors (and their respective IRS dependents, immediate family members [children, spouse, parents, siblings] and individuals residing in their same household, whether or not related) of Sponsor, Administrator, Ocean Media, Inc., Fox Cable Network Services, LLC, Fox Entertainment Group, Nology Interactive, Inc., eHarmony.com, Inc., and The News Corporation (each a “Promotion Entity” and collectively, the “Promotion Entities”), and their respective parents, subsidiaries and affiliated companies, advertising, promotion, production services, fulfillment agencies, legal advisors, web masters and web suppliers are not eligible to participate. By participating, each entrant unconditionally agrees to abide by these Official Rules and the decisions of the Sponsor and/or judges, which shall be final and binding in all matters relating to this Sweepstakes.
3. HOW TO ENTER: No purchase necessary to enter or win. Making a purchase will not improve your chances of winning. A computer with Internet access is required to participate in this Promotion. The Promotion begins at 12:00:01 a.m. Eastern Standard Time (“EST”) on June 18, 2007, and ends at 11:59:59 p.m. EST on July 15, 2007 (“Promotion Period”). All entries must be received by the end of the Promotion Period, to be eligible. To enter a Sweepstakes, visit www.fsndreamdate.com (the “Website”) and follow the links to the registration page. To be eligible, each entrant must submit all requested information including the entrant’s name, residential address, phone number, email address, marital status, and the selection of the prize drawing category entrant would like to enter. Limit of one (1) entry per person and/or per e-mail address. Each entrant must provide a valid e-mail address to be eligible. In the event of a dispute regarding the identity of who actually submitted an entry on the Website, the entry will be deemed submitted by the authorized account holder of the e-mail address supplied at the time of entry. An “authorized account holder” is defined as the natural person to whom the applicable e-mail address has been assigned by the internet access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the address submitted. The potential winner may be required to provide Sponsors with proof that he/she is the authorized account holder of the e-mail address associated with the winning entry. If a dispute as to the identity of any entrant (online or otherwise) cannot be resolved to Sponsor’s satisfaction, the entry will be deemed ineligible.
All entries become the exclusive property of Sponsor and will not be acknowledged or returned. Personal information collected in connection with this Promotion may be shared with the Promotion Entities and Sponsor's other promotional partners and will be used by Sponsor and such promotional partners in compliance with their respective privacy practices. Entry must be made by the entrant, only in the manner as set forth herein. All other methods of entry are considered void. 4. DRAWING AND NOTIFICATION: The Promotion consists of nineteen (19) independent Sweepstakes, one (1) Sweepstakes drawing for each participating Region (as defined in the chart below) with the exception of the FSN Florida, FSN Southwest, and Sports Net Chicago Regions, which shall each have two (2) independent Sweepstakes drawings. Participants of each Region’s Sweepstakes drawing will be determined according to each entrant’s prize drawing selection as noted on each entrant’s Sweepstakes entry. Each Region’s potential winner will be selected in a random prize drawing on or about July 17, 2007, from all eligible entries received for the Sweepstakes corresponding with that Region. Each Region’s potential winner(s) will be notified by e-mail and/or U.S. mail on or about July 19, 2007, using the contact information provided at the time of entry. If the Region’s selected prizewinner(s) cannot be reached by e-mail or U.S. mail, two (2) attempts will be made to notify the potential winner over a ten (10) day period following the initial attempt to notify such potential prizewinner. If Sponsor is unable to notify a potential prizewinner, within this timeframe, the prize may be forfeited and an alternate winner may be selected at random from the remaining eligible entries. In connection with each Region’s prize drawing, Sponsor, in its sole discretion, will attempt to contact up to three (3) potential prizewinners in accordance with the above procedure, after which the prize may go unawarded if it remains unclaimed. If a winner is considered to be a minor in his/her jurisdiction of residence, prize may be awarded in the name of, or to, winner's parent/legal guardian who must execute all documents and agree to all obligations and undertakings of winner, both on behalf of himself/herself and the winner, or prize may be forfeited and an alternate winner may be selected at random from the remaining eligible entries.

5. PRIZE/APPROXIMATE RETAIL VALUE (ARV)/ODDS: One prize is available for each Region's Sweepstakes drawing (with the exception of the FSN Florida, FSN Southwest, and Sports Net Chicago Regions, which shall each have two (2) prizes available). Each prize shall consist of the following: (i) admission for two (2) to a big league baseball game (exact game date is at Sponsor's sole discretion) during the 2007 season; (ii) roundtrip ground transportation within a 75-mile radius of the big league baseball game’s location (transportation provider to be selected by Sponsor in its sole discretion); and (iii) One Hundred Dollars ($100). The Approximate Retail Value (“ARV”) for each prize is Three Hundred Thirty Dollars ($330). The prizewinner is solely responsible for all taxes associated with accepting the prize and all other expenses not specified herein as being awarded. The odds of winning a Sweepstakes depend on the number of eligible entries received for that Sweepstakes. The total ARV for all prizes is Six Thousand Two Hundred Seventy Dollars ($6,270).
6. PRIZE CONDITIONS: Eligibility, age and all claims made by winner(s) are subject to verification. Sponsor and its agents are not responsible for fraudulent communications including without limitation phone calls, mail, and e-mails made or sent to entrants. Each Region’s prizewinner may be required to execute an Affidavit of Eligibility, a Liability Release and a Publicity Release (“Affidavit/Publicity Release”). The Affidavit/Publicity Release must be returned within the time indicated on the documents. If the Region’s potential prizewinner fails to return such documents within the prescribed time, or if a potential prizewinner is found to be ineligible, or if he/she does not comply with these Official Rules, then the potential prizewinner will be disqualified and an alternate winner may be selected from the remaining eligible entries. All applicable U.S., Federal, state, and local taxes, duties, or other taxes or fess are the sole responsibility of each prizewinner, who may be issued a 1099 IRS tax form for the ARV of any awarded prize. Except where such condition is expressly prohibited by law, the winner’s entry and acceptance of the prize constitutes permission for the Sponsor and its agents to use said winner’s name, photograph, likeness, statements, biographical information, voice, and city and state address for all purposes and in all forms of media, in perpetuity, without further notice or compensation.
Depiction of the prizes in any advertising, promotional materials, or on the Sweepstakes website (if any) may not reflect the actual prize delivered to the winner. Sponsor or its agents shall not be responsible for delays in delivery of any prize once it has been shipped by Sponsor or its agent. Winner shall bear all risk of loss or damage to the prize after it has been delivered to the winner. Prizewinners cannot assign or transfer their prize to another person or entity and are not entitled to cash in place of any prize. Each prize is subject to availability and Sponsor in its sole discretion may substitute cash or a different prize of approximately equal or greater retail value except where prohibited by law. No transfer, substitution, or cash equivalent for prizes allowed except at Sponsor’s sole discretion due to prize unavailability and then only for a prize of equal or greater value.
7. PRIZE RESTRICTIONS: Each potential prizewinner is subject to verification. All information and materials submitted to Sponsor become the sole property of Sponsor and will not be returned. No correspondence will be acknowledged or entered into. If any potential winner declines a prize, is found to be ineligible, or fails to comply with these Official Rules, such potential winner will be disqualified and will forfeit the prize he or she otherwise might have received. Upon verification of a potential prizewinner's eligibility, and compliance with these Official Rules, prizewinner will receive further notification with details on how to claim the prize.
8. CONDITIONS OF PARTICIPATION: This Promotion is subject to all applicable federal, state, and local laws. Each entrant hereby: (a) agrees that the Promotion Entities and their respective parent, subsidiaries and affiliated companies, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents will have no liability whatsoever for, and shall be held harmless by participants against any liability for any injuries, losses or damages of any kind to person(s), including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this Sweepstakes or any Sweepstakes-related activity, or for any typographical or other error in the printing, offering or announcement of any prize; (b) releases the Promotion Entities and their parent companies, subsidiaries, distributors, affiliates, advertising and promotion partners, fulfillment and/or judging agencies, retailers, franchises, agents and their estate and/or family members from all liability, claims, action, or proceedings relating to this Sweepstakes and from injuries or damages arising in connection with or relating to participation in this Promotion, or use or misuse of the prize; and (c) waives any right to claim ambiguity in the Promotion, a Sweepstakes or these Official Rules. By accepting the prize, each winner further acknowledges that the Sponsor and any other entity involved with this Promotion have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied in fact or in law, relative to the prize or prize suppliers or to any portion thereof, including but not limited to its quality, merchantability, mechanical condition, or fitness for a particular purpose including, without limitation, use of any equipment associated with the prize. All taxes and other expenses not specified herein, including federal, state, local, licenses and registrations are the sole responsibility of the winner. All federal, state, and local laws and regulations apply. Sponsor reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Promotion, to void suspect entries and/or cancel, terminate or suspend a Sweepstakes should a virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor corrupt or impair the administration, security, fairness or proper play of a Sweepstakes and, in any such event, at its discretion, select winners from eligible, non-suspect entries received prior to the event requiring such termination, cancellation or suspension.
9. LIABILITY LIMITATIONS: The Promotion Entities are not responsible for lost, late, stolen, misdirected, or non-delivered entries, or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider ("ISP"), mobile carrier, website or other connections availability, accessibility or traffic congestion, miscommunications, or failed computer, network, telephone, satellite, cable hardware, software or lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network, or the incorrect or inaccurate capture of entry or other information or the failure to capture or loss of any such information. The Promotion Entities are not responsible for any incorrect or inaccurate information, whether caused by internet users, or by any equipment or programming associated with or utilized in connection with a Sweepstakes and assume no responsibility for any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, tampering or hacking. Sponsor reserves the right, at its sole discretion, to disqualify any entrant it finds to be tampering with entry process or operation of a Sweepstakes or to be acting in an unsportslike or disruptive manner, or with intent to threaten, abuse or harass any other person.
IN NO EVENT WILL THE PROMOTION ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR PARTICIPATION IN THE PROMOTION. WITHOUT LIMITING THE FOREGOING, ALL PRIZES AND EVERYTHING IS PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND THE PROMOTION ENTITIES HEREBY EXPRESSLY DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE RIGHT IS RESERVED TO SEEK DAMAGES TO THE FULLEST EXTENT OF THE LAW.
